En el documento que se firma con la cooperativa se establece expresamente que la cooperativa \u201c<b>se obliga a transferir la propiedad de la vivienda arriba indicada a D \u2026\u2026\u2026..una vez se halle finalizada su construcci\u00f3n<\/b>\u201d.<\/p><p>Tres meses despu\u00e9s de firmar este documento, los c\u00f3nyuges contraen matrimonio, se someten a la legislaci\u00f3n foral aragonesa y dos a\u00f1os despu\u00e9s, comparecen ante el notario para otorgar la escritura p\u00fablica de compraventa, acto que realizan en beneficio de la sociedad consorcial.<\/p><blockquote><p>La discusi\u00f3n se plantea en un procedimiento de liquidaci\u00f3n de la sociedad consorcial en la que se discute el car\u00e1cter consorcial o privativo de \u00e9ste inmueble<\/p><\/blockquote>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-ee946a4 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"ee946a4\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-e67edfc\" data-id=\"e67edfc\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-5815aed elementor-widget elementor-widget-heading\" data-id=\"5815aed\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">MI OPINI\u00d3N: CONSIDERO QUE EL BIEN ES CONSORCIAL<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-66a3ce0 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"66a3ce0\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-1e01ac4\" data-id=\"1e01ac4\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-3463c8e elementor-widget elementor-widget-text-editor\" data-id=\"3463c8e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"text-decoration: underline;\"><strong>Mis argumentos son los siguientes<\/strong><\/span>:\u00a0<\/p><p>El contrato firmado por el esposo y la cooperativa antes del matrimonio es un contrato que obliga a las partes, se estipula un precio, una forma de pago, pero no se transmite la propiedad, no hay tradici\u00f3n, ya que esta se demora conforme a dicho documento, al momento en el que se halle finalizada la construcci\u00f3n. Hasta ese momento, hasta el otorgamiento de la escritura p\u00fablica de compraventa en el que los ya c\u00f3nyuges adquieren para su sociedad conyugal, el \u00fanico titular del inmueble es la Cooperativa.<\/p><blockquote><h3 class=\"documento-tit\"><span class=\"vcitation\"><a class=\"vcitation__link\" href=\"https:\/\/go.vlex.com\/vid\/70293394?fbt=webapp_preview&amp;addon_version=6.8\" target=\"_blank\" rel=\"noopener\" data-vids=\"70293394\">Ley 15\/1967, de 8 de abril<\/a>, sobre compilaci\u00f3n del Derecho civil de Arag\u00f3n.<\/span><\/h3><p><strong>Art\u00edculo treinta y siete. Bienes comunes.<\/strong><br \/>\u00abConstituyen el patrimonio com\u00fan: Primero. Los bienes inmuebles o sitios adquiridos a t\u00edtulo oneroso constante matrimonio, por cualquiera de los c\u00f3nyuges a costa del caudal com\u00fan.\u00bb<\/p><\/blockquote>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-65e26a7 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"65e26a7\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-dfb793e\" data-id=\"dfb793e\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-c19e215 elementor-widget elementor-widget-text-editor\" data-id=\"c19e215\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Establece por ello este precepto \u201cla adquisici\u00f3n onerosa\u201d como negocio jur\u00eddico a examinar y ello porque, el art 38 del mismo cuerpo legal, otorga el car\u00e1cter privativo a los inmuebles \u201caportados\u201d, es decir, aquellos cuya titularidad dominical ya la ostentaba uno de los c\u00f3nyuges al contraer matrimonio. Resulta por ello necesario determinar cu\u00e1l es el negocio jur\u00eddico que, en el caso que nos ocupa, transfiere la propiedad:<\/p><ul><li>si el documento privado por el que el esposo pasa a ser socio de la cooperativa, pero no propietario del inmueble, o<\/li><li>la escritura p\u00fablica conforme a la cu\u00e1l, la Sociedad Cooperativa, transfiere mediante su adjudicaci\u00f3n, el inmueble a los c\u00f3nyuges, quienes literalmente adquieren \u201ccon el car\u00e1cter de com\u00fan\u201d.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-50e9ebb elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"50e9ebb\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-8b20b36\" data-id=\"8b20b36\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-b210b15 elementor-widget elementor-widget-text-editor\" data-id=\"b210b15\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Una <span style=\"text-decoration: underline;\"><strong>COOPERATIVA DE VIVIENDAS<\/strong><\/span> es una sociedad de capital variable y estructura y gesti\u00f3n democr\u00e1ticas que asocian en r\u00e9gimen de libre adhesi\u00f3n y baja voluntaria a un m\u00ednimo de socios, que tienen por inter\u00e9s com\u00fan el de conseguir a trav\u00e9s de una actividad empresarial cooperativizada el uso o la propiedad de viviendas y\/o locales o instalaciones complementarias de su propiedad para s\u00ed y las personas que convivan con ellos.<\/p><p>Este car\u00e1cter \u00abmediador\u00bb de las cooperativas de viviendas introduce algunas peculiaridades en lo que respecta a la promoci\u00f3n y transmisi\u00f3n de la propiedad inmobiliaria en relaci\u00f3n a los socios cooperativistas que han sido puestas de manifiesto en los trabajos sobre el tema de TRUJILLO D\u00cdAZ.\u00a0<\/p><p>El ingreso del socio en la cooperativa, no es un arrendamiento de obra ni una compraventa de piso futuro<span class=\"vcitation\">\u00a0(de ah\u00ed la inaplicaci\u00f3n de la normativa protectora de consumidores a los socios, v.\u00a0<a class=\"vcitation__link\" href=\"https:\/\/go.vlex.com\/vid\/18170726?fbt=webapp_preview&amp;addon_version=6.8\" target=\"_blank\" rel=\"noopener\" data-vids=\"18170726\">SAP C\u00e1diz 25.7.2005<\/a>, AC 1647, Madrid, 30.3.2006, AC 1735), sino el resultado de un contrato de tipo asociativo, aunque \u00e9ste se acompa\u00f1e de cl\u00e1usulas de adjudicaci\u00f3n provisional por precio aproximado, o de las que facultan la separaci\u00f3n del adquirente del proyecto, presentando un sustituto (<a class=\"vcitation__link\" href=\"https:\/\/suabogadoencasa.wordpress.com\/search\/jurisdiction:ES+tipo_resolucion_1:SEN+date:1990-11-12..1990-11-12+source:102+content_type:2\/*?fbt=webapp_preview&amp;addon_version=6.8\" target=\"_blank\" rel=\"noopener\" data-new-href=\"\/search\/jurisdiction:ES+tipo_resolucion_1:SEN+date:1990-11-12..1990-11-12+source:102+content_type:2\/*\" data-vids=\"209084683 209082707\">STS 12.11.1990<\/a>, RA 8702). <\/span><\/p><blockquote><p><span class=\"vcitation\">El pago de las aportaciones sociales y las cuotas de entrada exigidas no son parte del precio de una compraventa aplazada del\u00a0<a class=\"vcitation__link\" href=\"https:\/\/go.vlex.com\/vid\/127560\/node\/1356?fbt=webapp_preview&amp;addon_version=6.8\" target=\"_blank\" rel=\"noopener\" data-vids=\"127560\" data-key-node=\"1356\">art. 1356<\/a>\u00a0<a class=\"vcitation__link\" href=\"https:\/\/go.vlex.com\/vid\/127560?fbt=webapp_preview&amp;addon_version=6.8\" target=\"_blank\" rel=\"noopener\" data-vids=\"127560\">CC<\/a>, sino la forma que tiene el socio de contribuir a la consecuci\u00f3n del objeto social.<\/span><\/p><\/blockquote>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-bc9eaf2 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"bc9eaf2\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-8184b16\" data-id=\"8184b16\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-b3e9dd5 elementor-widget elementor-widget-text-editor\" data-id=\"b3e9dd5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Si seguimos analizando el contrato de cooperativa y la historia registral de la finca en cuesti\u00f3n, se observa, aparte de los pagos efectuados antes de la adjudicaci\u00f3n, que en el momento del otorgamiento de la escritura p\u00fablica de compraventa, los c\u00f3nyuges se subrogan en un pr\u00e9stamo hipotecario que hasta aquella fecha estuvo concedido a la Sociedad Cooperativa.<\/p><blockquote><p>Dif\u00edcilmente podemos entender al esposo como propietario de un inmueble sobre el que existe constituida una garant\u00eda hipotecaria que obliga a la Cooperativa, \u00fanica que tiene la facultad de gravar, disponer, enajenar\u2026 ejercer todas las facultades dominicales que le otorga el car\u00e1cter de propietario<\/p><\/blockquote>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-7c7a539 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"7c7a539\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-1f6cc25\" data-id=\"1f6cc25\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-f730ea0 elementor-widget elementor-widget-heading\" data-id=\"f730ea0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Este an\u00e1lisis es \u00fanicamente fruto de un estudio de un asunto concreto, fundado en una opini\u00f3n jur\u00eddica del letrado que suscribe y que, por ello, puede estar sujeto a cualquier otra opini\u00f3n jur\u00eddica mejor fundada en derecho<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-865dc04 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"865dc04\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column
