{"id":2885,"date":"2023-10-18T18:16:47","date_gmt":"2023-10-18T18:16:47","guid":{"rendered":"https:\/\/abogado-zaragoza.com\/?p=2885"},"modified":"2023-10-25T16:04:14","modified_gmt":"2023-10-25T16:04:14","slug":"quien-debe-de-paga","status":"publish","type":"post","link":"https:\/\/abogado-zaragoza.com\/index.php\/2023\/10\/18\/quien-debe-de-paga\/","title":{"rendered":"\u00bfQUI\u00c9N DEBE DE PAGAR LAS COMISIONES Y GASTOS DE UN PR\u00c9STAMO HIPOTECARIO?"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"2885\" class=\"elementor elementor-2885\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-ffc3976 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"ffc3976\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-5c86a5f\" data-id=\"5c86a5f\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-c4e5956 elementor-widget elementor-widget-text-editor\" data-id=\"c4e5956\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Puede reclamar los gastos de gestor\u00eda, notar\u00eda, AJD o registro de algunas hipotecas.<\/p><blockquote><p><strong>A\u00fan est\u00e1 a tiempo de saber si ha sido afectado por el cobro de cl\u00e1usulas abusivas y c\u00f3mo reclamar los costes a su entidad bancaria.<\/strong><\/p><\/blockquote><p><span style=\"text-decoration: underline;\"><strong>Cu\u00e1l es el plazo para poder reclamar<\/strong><\/span><\/p><p>El plazo para solicitar la devoluci\u00f3n de gastos derivados de una cl\u00e1usula declarada abusiva es de\u00a0<strong>cinco a\u00f1os desde que se conoci\u00f3 que la cl\u00e1usula era abusiva.<\/strong><\/p><p>No obstante la prescripci\u00f3n de la acci\u00f3n ha sido tratada de muy diversas maneras por nuestros Tribunales, tal y como se explica de manera m\u00e1s detallada en esta <a href=\"https:\/\/abogado-zaragoza.com\/index.php\/2023\/10\/21\/desde-que-momento-comienza-a-corres-el-plazo-de-prescripcion-en-la-reclamacion-por-gastos-y-comisiones-en-prestamos-hipotecarios\/\" target=\"_blank\" rel=\"noopener\">entrada<\/a><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-8768c9a elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"8768c9a\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-7c904f2\" data-id=\"7c904f2\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-895d729 elementor-widget elementor-widget-text-editor\" data-id=\"895d729\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>C\u00f3mo reclamar<\/strong><\/p><p>Desde este Despacho de Abogados le asesoraremos y estudiaremos su caso concreto.<\/p><p>Su banco no est\u00e1 obligados a devolverle las cantidades cobradas de m\u00e1s de forma voluntaria, por lo que, si quiere reclamar, lo primero que debe hacer es reunir toda la informaci\u00f3n y facturas relacionadas con los gastos a reclamar.<\/p><p>Una vez hecho este paso, se debe presentar una reclamaci\u00f3n ante el\u00a0<strong>Servicio de Atenci\u00f3n al Cliente<\/strong> o ante el <strong>Defensor del Cliente<\/strong> e su entidad Bancaria ante la que otorg\u00f3 el pr\u00e9stamo hipotecario.\u00a0<\/p><p>El Banco debe responderle a la reclamaci\u00f3n en un plazo m\u00e1ximo de un mes y si transcurrido este periodo no obtiene respuesta o no queda satisfecho con ella, podr\u00e1 acudir al Servicio de Reclamaciones del Banco de Espa\u00f1a.<\/p><p>Otra opci\u00f3n es acudir a la\u00a0<strong>v\u00eda judicial <\/strong>donde se valorar\u00e1 y sentenciar\u00e1 si, analizado su pr\u00e9stamo hipotecario, se dan las condiciones para considerar las cl\u00e1usulas como abusivas, en cuyo caso se considerar\u00e1n nula.
