{"id":2865,"date":"2023-10-11T16:30:19","date_gmt":"2023-10-11T16:30:19","guid":{"rendered":"https:\/\/abogado-zaragoza.com\/?p=2865"},"modified":"2023-10-11T17:40:06","modified_gmt":"2023-10-11T17:40:06","slug":"documentacion-que-se-necesita-siempre-en-un-procedimiento-de-segunda-oportunidad","status":"publish","type":"post","link":"https:\/\/abogado-zaragoza.com\/index.php\/2023\/10\/11\/documentacion-que-se-necesita-siempre-en-un-procedimiento-de-segunda-oportunidad\/","title":{"rendered":"DOCUMENTACI\u00d3N QUE SE NECESITA SIEMPRE EN UN PROCEDIMIENTO DE SEGUNDA OPORTUNIDAD"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-post\" data-elementor-id=\"2865\" class=\"elementor elementor-2865\">\n\t\t\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2edc299 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2edc299\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-7bd93a8\" data-id=\"7bd93a8\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2dda2e7 elementor-widget elementor-widget-text-editor\" data-id=\"2dda2e7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Una de los principales problemas que nos encontramos los profesionales del derecho a la hora de iniciar un Procedimiento de Exoneraci\u00f3n del Pasivo Insatisfecho, es la de recopilar toda la documentaci\u00f3n que justifica la situaci\u00f3n econ\u00f3mica del cliente as\u00ed como, y esto es important\u00edsimo, toda la relativa a la identidad de los acreedores, el importe de sus deudas y el origen de las mismas.<\/p><p>Tenemos que tener muy presente que la fundamentaci\u00f3n de este procedimiento est\u00e1 en darle a quienes se encuentran en una situaci\u00f3n de insuficiencia patrimonial para poder hacer frente a sus deudas, una nueva oportunidad de, saldando sus deudas, comenzar de nuevo con su mochila mucho \u00abm\u00e1s ligera\u00bb.<\/p><p>Es altamente recomendable que una de las primeras cosas que el cliente debe de gestionar, si es que no lo ha hecho ya con anterioridad, es su <a href=\"https:\/\/www.sede.fnmt.gob.es\/certificados\/certificado-de-representante\/administrador-unico-solidario\/solicitar-certificado\" target=\"_blank\" rel=\"noopener\">certificado digital<\/a>. Este certificado nos servir\u00e1 para poder conseguir a trav\u00e9s de las diversas plataformas p\u00fablicas (Seguridad Social, AEAT, Catastro, Ayuntamiento &#8230;), una serie de certificados p\u00fablicos que son imprescindibles acompa\u00f1ar a la demanda de exoneraci\u00f3n.<\/p><p>Igualmente tenemos que tener bien presente que la intervenci\u00f3n del procurador en este tipo de procedimientos, debe de ser mediante \u00abpoder especial\u00bb, rechazando los Juzgados la tramitaci\u00f3n del procedimiento si, llegado el caso de que este no se acompa\u00f1ara, no se subsanara esta deficiencia en plazo.<\/p><p>Enumero aqu\u00ed una serie de documentos que siempre deberemos acompa\u00f1ar a la demanda, as\u00ed como la informaci\u00f3n que deber\u00eda de ofrec\u00e9rsele al abogado que vaya a llevar el procedimiento, para que \u00e9ste se desarrolle sin la omisi\u00f3n de esta esencial documentaci\u00f3n.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-027585b elementor-view-default elementor-invisible elementor-widget elementor-widget-icon\" data-id=\"027585b\" data-element_type=\"widget\"
